I-4-3-89.Appeals Council Decisions — Releasing

A. Favorable Decisions

  1. The analyst and support staff must:

    • Prepare, in final, the decision and any additional documents required.

    • Prepare, in final, the appropriate cover letter, inserting the dates indicated if the decision is partially favorable, and addressing the letter to the claimant's representative with a copy to the claimant.

    • Address an envelope to the claimant and supply a window envelope for the representative's copy of the letter and decision.

    • Prepare transmittal slips as follows:

      • 3 copies of transmittal slip to file destination indicated on instruction form; if more than one destination is indicated, such as in concurrent cases, prepare 3 copies for each destination

      • 1 copy of transmittal slip to OGC

  2. After the AAJs sign the decision, the support staff will make appropriate ACAPS inputs, and return it to the CCPRB, the CCPRB support staff must:

    • Check to make sure both AAJs signed decision and the “A” member signed the cover letter.

    • Mark the final release date on the Court Case Control and Routing Slip.

    • Date stamp all copies of the letter, decision, PRTF (if any) and transmittal slips.

    • Send or distribute the copies according to the footers appearing at the bottom of the cover letter and AC decision. If no approved fee agreement is in file, include a copy of the Fee Petition Instructions and a Form SSA-1560-U4 (see http://www.socialsecurity.gov/online/ssa-1560.html) with the representative's copy, if the claimant is represented by an attorney.

    • Enter the pertinent data into OHA CCS.

    • Update the LOTS.

    • In concurrent Title II/Title XVI cases, split the files according to the guidelines in section I-4-3-117.

    • In a sentence 6 case, if the claimant or the claimant's counsel notifies us that the litigation will be continued, put the CF on the shelf for preparation of a supplemental CAR.

B. Unfavorable Decisions

  1. The analyst and support staff must:

    • Prepare, in final, the decision and any additional documents required.

    • Prepare, in final, the cover letter addressing the letter to the claimant's representative with a copy to the claimant.

    • Address an envelope to the claimant and supply a window envelope for the representative's copy of the letter and decision.

  2. After the AAJs sign the decision and return it to the support staff, the support staff must:

    • Check to make sure the AAJs signed both the letter and the decision.

    • Mark the final release date on the Court Case Control and Routing Slip.

    • Date stamp all copies of the letter and the decision.

    • Send or distribute the copies according to the footers on the decision and cover letter.

    • Enter the pertinent data into OHA CCS and ACAPS.

    • Update the LOTS.

    • Forward the files for the preparation of a CAR, if necessary (see above).
