Background

HALLEX Sections I-2-8-13 Use of Proposed Language Supplied by Claimants and Representatives in Preparation of Fully Favorable and I-2-8-98 Exhibit - Information for Claimants and Representatives About Submitting Proposed Language That May Be Used in the Hearing Decision Or Bench Decision Checksheet have been revised to remove all outdated references to OHA and short term initiative. The business process has also been changed to eliminate the routing of proposed decisions through a decision writer. We also included references to a downloadable version of the Findings Integrated Templates on the SSA website.

Explanation of Content and Changes

I-2-8-13 is amended to allow the claimant or claimant representative to submit proposed decisional rationale and proposed findings of fact and conclusions of law in any case and at any time in the hearing process beginning with the filing of the request for hearing and extending through any post hearing time limit set by the ALJ.

I-2-8-98 is amended to allow the claimant or claimant representative, if they believe the law and evidence support a fully favorable decision, to submit proposed language for the decision to the Administrative Law Judge (ALJ) at any time in the hearing process beginning with the filing of the request for hearing and extending through any post hearing time limit set by the ALJ.
