Subject: General Subjects

Background

This transmittal amends the Temporary Instruction (TI) I-5-1-17 to incorporate necessary instructions because the “FIT for Representatives” software is no longer available, and we no longer permit claimants or representatives to submit proposed checksheet documents. We also clarified language about what constitutes a “wholly favorable decision” and clarified that the claimant may amend his or her onset date in writing or orally at the hearing. We also removed the sample decision notice at attachment 1 and redesignated attachment 2 as attachment 1. We made minor formatting and language changes to improve readability throughout the TI.

Explanation of Content and Changes

I-5-1-17 III.A. – We included language stating that a “wholly favorable” decision includes one in which the ALJ decides that the claimant is disabled on the claimant's alleged onset date. We also clarified that a claimant may amend his or her onset date in writing or orally at the hearing.

I-5-1-17 III.F. – We removed this subsection because we no longer permit claimants or representatives to submit proposed checksheet documents.

I-5-1-17 III.G. – We redesignated this subsection, “III.F.” because we removed the previous subsection F. We made no changes to the content.

I-5-1-17 Attachment 1 was removed because it is outdated and because the current version of the notice is available in the Document Generation System. Consequently, we redesignated existing Attachment 2 as Attachment 1.
