Action Note

Make the following pen and ink changes in the attachments to HALLEX Temporary Instruction (TI) 5-301, Supplement A, formerly Interim Circular No. 149, Supplement A.

Explanation of Content and Changes

HALLEX I-5-301, Supplement A, issued April 15, 1983, provided instructions for processing benefit continuation provisions for medical cessation cases under P.L. 97-455. When enacted in January 1983 and at the time these instructions were issued, the benefit continuation provision was temporary. However, the Omnibus Budget Reconciliation Act of 1990 amended section 223(g) of the Social Security Act and made permanent the provision permitting a claimant to elect continuation of benefits through the Administrative Law Judge (ALJ) hearing level in disability medical cessation cases.

This “Action Note” is being issued to revise the attachments in TI 5-301, Supplement A, to reflect that the benefit continuation provision is permanent and did not expire in June 1984, as previously indicated in the TI.
