Subject: Campbell, et al. v. Sullivan

Background

On April 25, 1990, the United States District Court for the Northern District of Iowa issued a final judgment amending a March 26, 1990 judgment in the Campbell, et al. v. Sullivan class action involving the “not severe” impairment issue. The court ordered the Secretary to reopen and readjudicate all class member claims. On November 19, 1990, the court filed the parties' joint stipulation on various implementation issues.

Explanation of Content and Changes

This instruction replaces TI 5-415, Campbell, et al. v. Heckler, that provided instructions for implementing the district court's October 21, 1985 and November 27, 1985 orders for class member relief. Those orders were subsequently vacated in light of the Supreme Court's decision in Bowen v. Yuckert, 482 U.S. 137 (1987).
