This chapter of the Appeals Text Guide portion of the OHA Standardized Text is being reissued. A signature line for the individual from the Public Health Service designated to serve on the panel with the Appeals Council has been added to the grant review notices in MED 20 and MED 21, where HCFA filed the request for review, and in MED 30 where the Appeals Council denies HCFA's request for review. The grant review action in MED 20 and MED 21 is not mandated as it is when a provider files a request for review. The action in these grant review situations and in the denial of HCFA's request for review should reflect consideration by the three-member panel, as provided in the regulations. However, in situations where granting the request for review is mandatory, i.e., where the provider files the request for review, there is no reason to delay the release of the grant review letter in order to obtain a third signature from PHS. Therefore, MED 22, MED 23, and MED 24 contain only two signature lines. regulatory citations have also been revised in each of the notices to show the reference to the code of Federal Regulations (CFR).
