BOLTON-SMITH COLLECTION

The Bolton-Smith Collection consists of documents and correspondence on social security legislation and programs, and on related subjects such as the Freedom of Information and Privacy Acts. The correspondence relates to legal aspects of the social security programs as these developed from bar association conferences, symposia, and seminars of the American Bar Association, Federal Bar Association, National Bar Association, local bar associations, and of coordinating legal educational groups such as the Practicing Law Institute and the American Law Institute. The researcher may trace these formative legal efforts through Congressional committee studies or reports and in legislation such as Public Law 94-202, which permitted hearing examiners to conduct hearings and render decisions on social security programs other than the Supplemental Security Income program to which they had been previously restricted.

The Collection also includes contributions from Mr. Bolton-Smith's former associates on Congressional committees as well as publications. from private sources paid by his personal funds.

Because the Administrative Law Judge program is administered by the Civil Service Commission and because approximately three-fifths of the ALJs on the Commission's register are personnel employed by the Bureau of Hearings and Appeals of the Social Security Administration, this suggests an area of conflict over the role of the administrative tribunal, personified by the Administrative Law Judge, and his independence in assuring a fair hearing. The Collection documents this conflict, in particular the issue resolved by P.L. 94-202 cited above.

A native of Memphis, Tennessee, Mr. Bolton-Smith earned degrees from Amherst and the University of Chicago Law School. He is still an active member of the Bars of New York, District of Columbia, and Tennessee. He has been admitted to practice law before the U.S. Supreme Court and several federal courts.

During the time which most of the Collection spans, Mr. Bolton-Smith served as Assistant to the Director for Liaison, Social Security Administration. Besides contributing to social security legislation, he worked hard to persuade the legal community to participate in social security programs and especially to represent social security claimants. During his stay with the Bureau of Hearings and Appeals, attorney participation increased from 9% to above 40%, and it is safe to conclude that this is a testimony to the contribution made by Mr. Bolton-Smith, which the Collection documents.
