I-1-7-8.Jurisdiction for Review of Class Claim Cases

If a court order requires readjudication of class claims, class claims involving the issue of disability are usually under the jurisdiction of the DDS which made the determination to be reviewed.

EXCEPTIONS:

A court order or settlement agreement may specify a certain level of review, i.e., the administrative level at which the readjudication of class member claims will take place, or the issue involved may be appropriate for review only at a particular level.
