I-3-10-11.Administrative Sanction Cases

Under the circumstances noted in 20 CFR 404.459 and 416.1340, an administrative law judge may impose an administrative sanction of nonpayment of benefits that would otherwise be payable to a person under title II or of ineligibility for cash benefits under title XVI. See Hearings, Appeals and Litigation Law manual I-2-10-16.

In such cases, the Appeals Council will use its usual procedures to decide the issue before it and determine whether there is a basis for granting review under 20 CFR 404.970 and 416.1470.
