Background

This transmittal adds section I-1-2-95 to the Hearings, Appeals and Litigation Law (HALLEX) manual to provide Office of Disability Adjudication and Review (ODAR) staff and adjudicators with instructions for handling an unprocessed form SSA-1695, Identifying Information for Possible Direct Payment of Authorized Fees.

Explanation of Content and Changes

We titled HALLEX I-1-2-95 “Handling a Form SSA-1695 For Direct Payment of Fees.” HALLEX I-1-2-95 explains the purpose of the SSA-1695 and notes that a completed form contains personally identifiable information about an appointed representative. The section explains that on receipt, ODAR will forward an SSA-1695 to the field office for processing. The instruction includes a NOTE explaining that ODAR does not delay case adjudication based on the processing of an SSA-1695. The section also provides information on removing the form from a file, even when ODAR mistakenly exhibited an unprocessed form.
