Background

This transmittal amends section I-1-1-3 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update the procedures for hearing office staff to notify a claimant of his or her right to representation.

Explanation of Content and Changes

I-1-1-3 – We changed the title of this section to “Maintaining and Providing Representative Referral Lists” to reflect the updated policy. We deleted the first paragraph as it duplicates the procedures set forth in new HALLEX section I-2-1-80. We also clarified that a claimant will be informed of a right to representation through a hearing request acknowledgement letter. We also made formatting and minor editorial changes throughout the section.
