Background

This transmittal reflects a decision by the Associate Commissioner to change the type of decision which an Administrative Law Judge (ALJ) will issue when a claimant abandons or withdraws a claim which a Federal court remanded to the Secretary for further proceedings. The transmittal also reflects the authority of individual ALJs to approve attorney's fees.

Explanation of Content and Changes

I-2-818 A. has been changed to show that when a claimant abandons or withdraws a claim which a Federal court remanded to the Secretary for further proceedings, the ALJ will issue a decision which documents the facts of the abandonment or withdrawal and the effect the claimant's action has on the proceedings.

I-2-818 B. 9. has been changed to show that in such a case, the ALJ will issue a final decision using the decisional shell shown in I-2-890, Exhibit 7.

I-2-818 C. 1. has been changed to show that the authority of individual ALJs to approve attorney's fees has been raised from $3,000 to $4,000.
