Subject: Administrative Law Judge Decisions

Background

This transmittal amends section I-2-8-37 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions for when an administrative law judge must issue a decision when the claimant dies while the request for hearing is pending. We also made minor editorial and formatting changes.

Explanation of Content and Changes

We revised section I-2-8-37 as follows:

HALLEX I-2-8-37 – We changed the title to “When Decision Is Needed if Claimant Dies While Request for Hearing Is Pending” to more accurately reflect the content of the section.

HALLEX I-2-8-37 A – We made minor formatting and editorial changes. We inserted helpful HALLEX citations and added a NOTE that incorporated the information previously in subsection C.

HALLEX I-2-8-37 B – We made minor editorial changes to the language.

HALLEX I-2-8-37 C – We removed the subsection as the information was incorporated into a NOTE in subsection A.
