Subject: Issues Before the Administrative Law Judge

Background

This transmittal amends Hearings, Appeals and Litigation Law (HALLEX) manual section I-2-2-20 to clarify the procedures for objecting to the issues to be decided at a hearing based on the final rule published in the Federal Register at 81 FR 90987. This new rule establishes nationally consistent procedures for case processing and remove the regulations in 20 CFR Part 405.

Explanation of Content and Changes

I-2-2-20 – We explain that a party to the hearing generally must submit any written objections to the issues to be decided at the hearing no later than five business days before the date of the scheduled hearing. We provide a reference to Note 1 in HALLEX I-2-5-1 NOTE 3, which defines “business day.” We also add an example to clarify that a party may object to the proposed exhibits at the hearing.
