Subject: Evaluating Allegations of Fraud or Similar Fault by the Claimant or Representative
This transmittal updates Chapter I-2-10 to memorialize existing hearings level guidance and procedures for adjudication of cases when a claimant or appointed representative alleges fraud or similar fault was involved in the providing of evidence.
I-2-10-1 – In subsection A., we added a cross- reference to I-2-10-12 when evaluating allegations of fraud or similar fault reported by the claimant or representative. We made minor editorial changes throughout to improve clarity.
I-2-10-12 – We created a new section titled “Evaluating Allegations of Fraud or Similar Fault by the Claimant or Representative.” This new section provides Office of Hearings Operations staff and adjudicators instructions for addressing allegations of fraud or similar fault.
