Background

This transmittal clarifies and updates the procedures relating to the scheduling and noticing of hearings contained in HALLEX Chapter I-2-3. These revisions reflect changes in technology, including the rollout of the electronic folder, and the use of the Document Generation System (DGS) and videoconference (VTC) technology.

Explanation of Content and Changes

I-2-3-1 eliminates citations to Medicare and the Black Lung Program.

I-2-3-5 eliminates references to the Black Lung and Medicare programs, and allows for out-of-jurisdiction claimants to appear by teleconference or to waive the right to an oral hearing.

I-2-3-10 is updated to include the use of VTC.

I-2-3-20 is updated to provide instructions for using DGS.

I-2-3-50 is updated in subsection D., Operating Procedures, for clarity and completeness.

I-2-3-90 is deleted. Instructions for accessing the Reminder to Return Acknowledgment Form in DGS is contained in I-2-3-20 C.
