Subject: Administrative Law Judge Decisions in Court Remand
This transmittal revises I-2-8-18 A. to restore language that was previously in this HALLEX section but was inadvertently changed in the September 2005 rewrite of this section.
I-2-8-18 A. is revised to state that in a court remand case in which the Appeals Council subsequently vacates the ALJ decision and remands the case to an ALJ for further proceedings and a new decision, the ALJ must consider all pertinent issues de novo.
