Background
This transmittal amends sections I-3-5-25 and I-3-5-70 of the Hearings, Appeals and Litigation Law (HALLEX) manual to include reference to Acquiescence Ruling (AR) 16-1(7), Boley v. Colvin.
Explanation of Content and Changes
HALLEX I-3-5-25 provides instructions for preparation and issuance of denial notices. We added AR 16-1(7) to the note in subsection B regarding appeal rights when an administrative law judge (ALJ) dismisses a request for hearing. We also made a few additional technical corrections and edits.
HALLEX I-3-5-70 provides instructions on denying requests for review of ALJ dismissals. We added a note regarding the application of AR 16-1(7) to notices in the 7th Circuit.
