Background

This transmittal amends chapter I-3-5 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update information relating to Appeals Council denials of requests for review.

Explanation of Content and Changes

HALLEX I-3-5 is amended as follows:

I-3-5-1 – We changed the title to “Appeals Council Denials – In General” and removed the citations as relevant citations were incorporated into the text. We also removed some text that was outdated that related to the content of denial notice action documents. We added subsection A titled “When the Appeals Council (AC) Will Deny Review” and incorporated some of the information previously in HALLEX I-3-5-1. We added other helpful regulatory and HALLEX citations. We added subsection B titled “General Procedures When the AC Denies Review,” and incorporated the remaining information from HALLEX I-3-5-1. We also incorporated information from HALLEX I-3-5-10, removing information that was duplicative of other HALLEX instructions and replacing the information with a relevant citation. We also added information about AC review of an analyst recommendation and included a helpful HALLEX citation for more information.

I-3-5-10 – We moved the information that was not outdated to HALLEX I-3-5-1 and removed the section in its entirety.
