Subject: General Workup and Analysis

Background

This transmittal amends section I-3-2-1 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update procedures to reflect that in certain circumstances the Appeals Council (AC) may address an extension of time (EOT) request with its action on a request for review.

Explanation of Content and Changes

I-3-2-1 – In subsection A, we deleted “extensions of time” from the third bullet in the list. After the bullet list, we added a new paragraph to direct the analyst to examine the claim(s) file for outstanding EOT requests and to consider if the AC should respond to any such request before performing a substantive review. We then added “NOTE 1” after the new paragraph to clarify that an acknowledgment letter should not be used to respond to a request for an EOT. We also added “NOTE 2” to explain the circumstances in which the AC may respond to an EOT request with its action on the request for review and provided language to be added to the action document. We also made minor editorial changes throughout the section.
