Subject: Appeals Council Remands
This transmittal amends Hearings, Appeals and Litigation Law (HALLEX) manual section I-3-7-40 to remove outdated guidance on split actions and update instructions relating to notifications of benefits continuation.
HALLEX I-3-7-40 – We deleted the Note in subsection A in its entirety because our procedures relating to split actions are now reflected in new HALLEX I-3-2-60. We amended subsection C.1. to clarify that the analysts are responsible for adding notifications related to payment continuation in ARPS and eView. In subsection C.2., we updated instructions to require analysts to send the notification for paper cases about the benefits continuation by emailing the MISC 505 transmittal to the hearing office control box. We also made minor editorial changes throughout to improve readability.
