Background

This transmittal amends section I-3-1-13 of the Hearings, Appeals and Litigation Law (HALLEX) manual to provide analysts in the Office of Appellate Operations instructions on how to refer possible policy or procedure issues.

Explanation of Content and Changes

HALLEX I-3-1-13 – We retitled the section, “Analyst Referrals of Possible Policy or Procedure Issues.”

HALLEX I-3-1-13 A – We removed outdated information previously in the section and added subsection A titled, “Referrals for Novel or Unusual Situations.” We provided instructions on when and how an analyst will handle a policy or procedure question.

HALLEX I-3-1-13 B – We added a new subsection B titled, “Referrals for Non-Compliance With Policy or Procedures.” In the subsection, we provide instructions for analysts on recommending feedback to the hearing operation.
