Background

This transmittal amends chapter I-3-8 of the Hearings, Appeals and Litigation Law manual to add instructions on how to address additional evidence when the Appeals Council (AC) issues a decision.

Explanation of Content and Changes

In addition to minor editorial changes throughout, we made the following substantive change to I-3-8-1:

I-3-8-1 C – We added instructions on how to handle additional evidence when the AC issues a decision. We state when the AC will exhibit additional evidence and when the AC will grant a protective filing date based on the receipt of additional evidence.
