Chapter: I-4-1
Subject: New Court Cases
This transmittal amends the Hearings, Appeals and Litigation Law (HALLEX) manual Chapter I-4-1 to update instructions regarding evidentiary material that is included in the administrative record for court proceedings. We also made other editorial and re-organization changes.
I-4-1-54 – We revised and deleted unnecessary and outdated information. We added new information explaining what evidentiary material is included in the administrative record prepared for court proceedings.
I-4-1-54 A – We moved content in this subsection to subsection E, and replaced it with content formerly found in subsection B. We re-organized and added information to reflect the appropriate procedures for electronic and paper cases.
I-4-1-54 B – We moved content in this subsection to subsection A, and replaced it with content formerly found in subsection F. We re-organized and added information to reflect the appropriate procedures for electronic and paper cases.
I-4-1-54 C – We moved content in this subsection to subsection E, and replaced it with content formerly found in subsection J. We re-organized and added information to reflect the appropriate procedures for electronic and paper cases.
I-4-1-54 D – We moved content in this subsection to subsection E, and replaced it with content formerly found in subsection K. We also made minor editorial changes.
I-4-1-54 E – We re-titled this subsection, “Special Considerations in Paper Cases” to reflect its new purpose. We consolidated the content of the subsection with the content formerly found in HALLEX I-4-1-54 subsections A, C, D, G, H, I, L, and M. We created five new sub-subsections to provide instructions for missing exhibit lists, missing exhibits, duplicate exhibits, exhibiting non-standard sized documents, and obtaining legible copies of documents. We also made other editorial and organizational changes to the language previously included in the HALLEX section.
I-4-1-54 F-M – We deleted these subsections and moved the content formerly found in these subsections to HALLEX I-4-1-54 subsections B-E, as explained above.
