Background

This transmittal amends chapter I-4-3 in the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions for an Appeals Council decision after a court remand.

Explanation of Content and Changes

Chapter I-4-3 is updated as follows:

I-4-3-80 – We changed the title to “Appeals Council Decisions After Court Remand” to more accurately reflect the content of the section. We added subsection A titled “General,” updated and incorporated information previously in HALLEX I-4-3-80 and I-4-3-85, and added a reference to the writing requirements in HALLEX I-3-8-20. We added subsection B titled “Analyst Recommendation to Issue a Decision,” and updated and incorporated information previously in HALLEX I-4-3-81 and I-4-3-87. We added subsection C titled “AC Action,” and updated and incorporated information previously in HALLEX I-4-3-88. We added subsection D titled “Releasing the Decision,” and updated and incorporated information previously in HALLEX I-4-3-89.

I-4-3-81 – We removed the section in its entirety as the information was incorporated in HALLEX I-4- 3-80.

I-4-3-82 – We removed this section in its entirety as the information was duplicative of information in HALLEX I-3-8-20.

I-4-3-83 – We changed the title to “Evidence or Issue Development After Court Remand” to more accurately reflect the content of the section. We made minor technical and formatting changes throughout the provision. We removed information in subsections C and D that was outdated and duplicative of information in HALLEX I-3-2-12 and I-3-8-10.

I-4-3-85 – We removed the section in its entirety as the information was incorporated in HALLEX I-4- 3-80.

I-4-3-87 – We removed this section in its entirety as the information was incorporated in HALLEX I-4- 3-80.

I-4-3-88 – We removed this section in its entirety as the information was incorporated in HALLEX I-4- 3-80.

I-4-3-89 – We removed this section in its entirety as the information was incorporated in HALLEX I-4- 3-80.

I-4-3-99 – We removed the section in its entirety as the information was outdated.

I-4-3-100 – We removed the section in its entirety as the information was outdated.

I-4-3-113 – We removed the section in its entirety as the information was outdated.
