Background

On August 24, 1987, OHA issued Temporary Instruction (TI) 5-418 (formerly Interim Circular No. 197) to comply with the terms of the Samuels court order and to provide instructions concerning the adjudication of pending cases.

Explanation of Content and Changes

We have modified the Definition of Class at II.B.2. and III.B.3. to reflect that, in order to be a Samuels class member, the claimant must have had a disability denial/cessation determination by the Tennessee Disability Determination Section.

Action

Make the following pen and ink change:

Insert “by the Tennessee Disability Determination Section” after the phrase “disability denial/cessation determination” in line 2 of section II.B.2. and again in line 3 of II.B.3. of TI 5-418.
