Background

This transmittal amends section I-5-6-1 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions for processing redeterminations under sections 205(u) and 1631(e)(7) of the Social Security Act for certain cases adjudicated in Puerto Rico.

Explanation of Content and Changes

To more clearly distinguish between cases that are pending and cases we are redetermining under sections 205(u) and 1631(e)(7) of the Social Security Act, we removed all instructions in HALLEX I-5-6-1 relating to pending cases and moved them to new HALLEX I-5-6-1A. We made numbering changes to correspond with the removal of this information, and made minor technical corrections and edits throughout the section. Finally, we added a minor clarification in subsection III.A.1. explaining one circumstance in which, due to a systems limitation, the hearing office will enter the necessary information on the closed system record instead of establishing a new case in the processing system.
