Background

This transmittal amends section I-5-6-2 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions for processing redeterminations of certain cases adjudicated in the Huntington, West Virginia hearing office.

Explanation of Content and Changes

We made the following changes in HALLEX I-5-6-2:

I-5-6-2 – We made minor updates throughout subsections I-III. We updated the instructions set forth in subsection IV and added additional instructions for screening and processing redetermined claims. In subsection V, we made minor updates to the existing instructions and added instructions for processing cases that were remanded by the Appeals Council for a redetermination decision. In subsection VI, we added instructions for processing a request for review submitted by a claimant after an administrative law judge issues a redetermination decision. We also added Attachment 3, which includes the notices the Appeals Council will use to notify a claimant that his or her claim is being redetermined (when required).
