I-4-5-35.Staff Responsibilities During Receipt and Processing of Requests for Voluntary Remand

A. Monitoring Notification of Request for Voluntary Remand
Attorneys in the Office of the General Counsel generally initiate a request for voluntary remand (RVR) of a pending court case by emailing a specific Court Case Preparation and Review Branch (CCPRB) mailbox based on the CCPRB jurisdictional breakdown (see Hearings, Appeals and Litigation Law manual I-3-0-7). The mailbox addresses are ^DCARO OAO Court 1 MAILBOX, ^DCARO OAO Court 2 MAILBOX, ^DCARO OAO Court 3 MAILBOX, ^DCARO OAO Court 4 MAILBOX, and ^DCARO OAO Court 5 MAILBOX. The subject field will show “RVR - Response requested by [insert date].” If the response date is less than seven (7) days from the date of the email, the subject field will show “RVR – Expedited response requested by [insert date].” Branch chiefs and court legal assistants will regularly check the branch mailboxes. After receipt of the RVR memorandum, the court legal assistant will enter the appropriate data into the Appeals Review Processing System for processing and assign the case to an analyst for review.
B. Timely Responding to Status Inquiries
When the Office of Appellate Operations receives an inquiry regarding supplemental review, the court legal assistant may respond directly to a status inquiry or similar request. For inquiries requesting substantive action, the court legal assistant will refer the request to the branch chief. Staff will ensure the appropriate case tracking system will be annotated to show the date and the nature of the material requested.
